Meet Kevin O’Hara of O’Hara Law

Today we’d like to introduce you to Kevin O’Hara.

Alright, so thank you so much for sharing your story and insight with our readers. To kick things off, can you tell us a bit about how you got started?
I started O’Hara Law during the early weeks of the global pandemic in March 2020. The timing was right, I believed that due to the shutdowns across the country, it was a good time to start getting everything in a row for the new firm. I also reached an agreement where I continued to work of counsel with the Simon Law Group while I was starting my new business.

The first several months were difficult, as the civil litigation world had slowed to a crawl due to the pandemic. Cases were not settling. Additionally, across the country, we were seeing injustices and police brutality, particularly against people of color. In June 2020, citizens took to the streets of Los Angeles to protest these injustices. Many of these citizens were wrongfully arrested for exercising their freedom of speech.

I had to do something to help. Around this time, I started offering free legal services for anybody who was wrongfully arrested or charged with a crime in connection with their freedom of speech and movement.

This pro bono work was rewarding. I helped dozens of individuals with their legal issues connected to the protests, including no charges imposed against any of my clients lawfully asserting their first amendment rights. This work also helped launch my first paid criminal defense cases.

An out-of-state individual was charged in connection with a robbery and hit-and-run accident and hired me to help him with his case. I helped him ultimately get his charges dismissed. I also helped expunge the criminal convictions for a rehabilitated man who was focused on furthering his education. I additionally prevented charges from being brought against multiple clients who had been arrested.

The majority of my practice is in personal injury, civil rights, or wrongful death. 100% of my caseload is dedicated to representing individuals and helping them get justice against corporations, the government, or wrongdoers.

In January 2022, my firm helped finalize a $2.75 million settlement against the County of San Bernardino for the wrongful death of Angela Zuniga, who was a pre-trial detainee who died in custody after complications during the birth of her child. We proved that the County was deliberately indifferent to her medical needs and had multiple opportunities to get her to the hospital, which would have prevented her ultimate death.

In February 2022, I started a jury trial in Napa, California on a motor vehicle accident with mild spine injuries. After winning my trial motions, the case settled for $175,000.00, more than 10x the last defense offer. At O’Hara Law, every case has the potential to go to trial if the Defense does not come prepared to offer a sum that will fairly make my client whole.

In June 2022, we reached a $2 million settlement against the City of Anaheim and Caltrans. My client was riding his bike home from work along a freeway overpass when his bicycle hit a hole in the ground. This hole was created from a dilapidated pullbox cover, which had previously been protecting the wiring for freeway streetlights. David lost several teeth and suffered a head injury. Google Maps photographs proved that the dilapidated pullbox had remained in a dangerous condition for years, despite personnel for Caltrans and Anaheim both visiting the vicinity of the condition on countless occasions to service the sidewalks, streetlights, and roadway. In a deposition, the City of Anaheim’s deputy public works director apologized for Anaheim’s role in causing this incident. This settlement will greatly help my client’s quality of life going forward.

We all face challenges, but looking back would you describe it as a relatively smooth road?
The pandemic was a struggle because during that time that cases were not settling (early days of the firm) it was difficult to make money.

Perseverance was worth it, as the firm is now thriving.
